Nigeria: N1.5 Billion Scam - Court Closes Case Against Swiss Firm
An Abuja High Court yesterday closed the case for further defence against Swiss firm Crown Forex SA in liquidation and two Swiss nationals over alleged breach of contract agreement with a Nigerian foreign exchange trading company.
Presiding judge S.E. Alade-Toyinbo also ordered the parties to adopt their submitted written addresses on the next adjourned date of September 26.
In a writ of summons filed in October, 2010 the Nigerian firm, 4RX Dimensions Ltd owned by Emmanuel Asiegbu, is demanding about N1.5 billion ($6.998m) against Phillippe Von Bredow and Laurent Winkelmann as damages, refunds and interest on funds over alleged breach of fiduciary obligations against the Geneva-based organisation.
Asiegbu's petition arose out of alleged non-disclosure of crucial information by the firm on the suspension of its operations by Swiss regulatory authority, the Swiss Financial Market Supervisory Authority (FINMA) and liquidators appointed due to its insolvency which, an action which resulted in his funnelling customer funds to it totalling the said amount.
He further averred that his firm entered a contract with the Swiss firm in 2008 to warehouse its overseas funds and offer other financial services for the purposes of trading in foreign exchange.
